Kay Pee Transformers Pvt. Ltd. provides transformer manufacturing India services through kaypeetransformers.com. These Terms of Service create a legal agreement between you (Customer) and Kay Pee Transformers Pvt. Ltd. (Supplier). First, they explain order rules for All Transformers. Next, they cover payment, delivery, and services clearly. As a result, both parties understand expectations completely.

These terms apply to all products, quotes, and services from our Kim, Surat facility.

1. Accepting These Terms

How You Agree

By requesting a transformer quote, placing an order, or using our services, you accept these Terms completely. First, read them carefully. Next, contact our general manager if questions exist. As a result, your order proceeds smoothly.

Changes to Terms

We may update these Terms. Continued use means you accept changes. Major updates get emailed to registered customers.

2. Order Process

Step-by-Step Ordering

  1. Request Quote: Fill contact form with transformer’s full specifications
  2. Review Proposal: Days valid as pe mentioned in quote with GA drawings
  3. Place Order: Accept full proposal in writing
  4. Order Confirmation: We email acceptance – production starts
  5. 9-Step Manufacturing: Follow our proven process
  6. Delivery: Risk passes on site delivery

Important: We reserve the right to refuse any order.

3. Products and Specifications

What You Receive

All transformers match your approved GA drawings:

All Transformers with custom specifications

Product Changes

Written approval required within 7 days of order:

  • OLTC upgrades
  • VPI transformer modifications
  • Capacity changes
  • Extra charges apply to all variations

4. Pricing and Payment Terms

Transparent GST – Exclusive Pricing

All prices exclude GST. No hidden charges.

Payment Schedule:

Advance Payment: 50% with confirmed Order
Balance Payment: before dispatch from Kim, Surat

Late Payment Penalties:

  • RBI reference rate + 8% annual interest
  • Legal recovery costs added
  • Title remains with Kay Pee until full payment

5. Delivery and Shipping

Delivery Timelines

Gujarat Local (Surat, Kim): As per mentioned in the Quotation.
India-wide: As per mentioned in the quotation.

Special Handling:

  • Packaging transformers: Dustproof & Weatherproof packaging
  • Loading transformers: Crane loading included from warehouse, kim.

Risk Transfer

Risk passes to the customer when the transformer reaches your site. Inspect within 7 days for defects.

6. Inspection and Acceptance

Your Responsibilities

Inspect immediately upon delivery:

  1. Check for physical damage
  2. Verify nameplate data matches GA drawings
  3. Test OCTC taps operation
  4. Notify defects in writing within 7 days

No notification = acceptance of delivered condition.

7. Warranty and Guarantees

18-Month Factory Warranty

Coverage from dispatch date or 12-month warranty: Starts on dispatch date OR installation date (whichever comes later)

  • Manufacturing defects
  • Poor workmanship

Free Services:

  • Repair/replacement at Kim, Surat factory
  • Gujarat transport included

Exclusions:

  • Overload beyond rated capacity
  • Improper installation
  • Site damage or misuse

8. Services Coverage

What Services Include

Transformer Services from Kim, Surat:

Service warranties: 6 months or 5000 operating hours.

9. Customer Responsibilities

During Manufacturing

  • Approve GA drawings within 5 working days
  • Provide site details for delivery
  • Ensure clear access for power transformer installation

During Installation

  • Follow our installation guidelines
  • Provide proper foundation and ventilation
  • Use certified electricians

10. Cancellation Policy

Cooling-Off Period

Cancel within 7 days of Order for full refund (no production started).

After Production Starts: No refunds on custom transformers.

11. Termination Rights

By Either Party

Immediate termination if:

  • Serious breach of these Terms
  • 30 days written notice to remedy
  • Payment default (30+ days)
  • Bankruptcy or liquidation

12. Liability Limitations

What We’re Not Responsible For

No liability for:

  • Delivery delays (estimated dates only)
  • Indirect losses (lost profits)
  • Customer misuse or improper installation
  • Force majeure (monsoons, power cuts)

Direct damages capped at order value.

13. Force Majeure Events

Excused Performance includes:

  • Gujarat monsoons affecting dispatch
  • Raw material supply shortages
  • Factory power failures
  • Government restrictions

60-day grace period before contract changes.

14. Dispute Resolution

Step-by-Step Process

  1. Contact our GM(General Manager) within 30 days
  2. Written resolution attempt (14 days)
  3. Surat arbitration if unresolved
  4. Continue services during disputes

15. Governing Law

Indian Law Applies
Exclusive jurisdiction of Surat District Courts, Gujarat.
